Lambeth Council Takes Legal Action Over Loughborough Estate Governance

Lambeth Council is preparing to initiate legal action in the High Court against the Loughborough Estate Management Board (LEMB). The move follows persistent concerns regarding governance, operational standards, and financial management at the estate.

The council aims to compel LEMB to take immediate steps to rectify these issues, including re-running a continuation ballot that will allow tenants and leaseholders to voice their opinions on the effectiveness of LEMB's management.

Escalating Concerns and Legal Intervention

The council formally communicated its demands to LEMB on March 13, requiring action within 14 days. Despite LEMB's request for an extension, which was initially granted for a further seven days until April 7, the board failed to provide a comprehensive response addressing the council's serious concerns. This lack of satisfactory engagement has led Lambeth Council to proceed with legal proceedings to ensure compliance with the management agreement and safeguard residents' rights to influence their estate's future.

A council spokesperson stated, "We have been patient and reasonable in seeking a response from LEMB, including granting an extension to the original deadline of March 27. The matters raised, in many cases, span several months of requests from the council that have simply gone unanswered or unsatisfactorily responded to."

The spokesperson added, "The response received does not provide sufficient assurance that robust measures are in place to address the serious issues identified. As a result, we have taken the decision to apply to the High Court to compel compliance with the management agreement and to protect residents’ ability to have their rightful say on the future management of their estate."

Background to the Dispute

Lambeth Council has identified significant concerns regarding LEMB's governance and management, including failures to meet key obligations outlined in the management agreement. These issues have been discussed extensively with LEMB's leadership over a sustained period. The required actions include re-running a ballot that complies with the management agreement, enabling residents to vote on whether LEMB should continue managing the estate or if management should revert to Lambeth Council.

Furthermore, the council has called for the convening of a valid Annual General Meeting (AGM). An online meeting held on February 19, 2026, was deemed invalid by the council due to insufficient attendance according to LEMB's own rules and the absence of formal resolutions.

The council has also highlighted issues related to allowing eligible residents to become shareholders, a process that grants them voting rights for board members. A council report from November 2025 indicated serious audit concerns surrounding financial management, governance, procurement, and value for money, with specific mention of unjustified spending on foreign travel and gifts.

Loughborough Estate Management Board operates as a Tenant Management Organisation (TMO). The council's ability to intervene has been historically constrained by TMO legislation and the terms of the Modular Management Agreement (MMA), which the council notes are now outdated. Lambeth Council is actively advocating for updated legislation to provide councils and residents with greater powers in such situations.
